§ 7. a. Invoicing and payment
Lürzer GmbH will confirm your order and send the invoice to your e-mail address once your credit card payment has been successfully processed. Lürzer GmbH shares information with partner firms engaged by Lürzer GmbH to charge/debit the credit card. Lürzer GmbH and partner firms engaged by Lürzer GmbH, accept American Express, VISA or MasterCard. If you prefer to pay after receiving the invoice or have any other questions, please contact Lürzer GmbH.
§ 7.b. Conclusion and revocation of contracts of purchase and sale
Lürzer GmbH hereby undertakes to accept the Purchaser’s order in accordance with the stated terms. In the event of spelling, printing or mathematical errors, Lürzer GmbH reserves the right to rescind the order.
Equally, the Purchaser may countermand the order in writing (also by email) or by returning the merchandise within a period of two weeks. It is to be noted that Lürzer GmbH may retain a part of the amount due to cover any diminution of value caused by prior use of the item returned.
§ 7.c. Payment terms, late payment
The purchase price is due upon placement of the order. The Purchaser may choose the “Bill me” option, i.e. ask to be invoiced. Should the Purchaser fall into arrears, Lürzer GmbH reserves the right to charge interest on late payment at a rate of 5% p.a. above the base rate as set by the European Central Bank at any one time. In the event that Lürzer GmbH can be shown to have suffered a higher loss due to delayed payment, Lürzer GmbH reserves the right to enforce such claims.
§ 7.d. Points to note when choosing the “Bill me” purchasing option
“Bill me” purchases, i.e. payment by the invoice option, is available to consumers aged 18 years or older only. Shipping address, postal address and billing address must all be identical. Lürzer GmbH reserves the right to withhold the payment option “Bill me” on certain types of order, and to refer the Purchaser to other payment options (e.g. cash on delivery). Invoiced amounts shall be due upon receipt of the invoice.
In the case of “Bill me” payments, Lürzer GmbH shall examine and verify the data supplied by the Purchaser and may, where there are grounds to justify such a course of action, submit such data to credit investigation bureaus. The results of any such investigation shall have an effect on the method of payment only, and not on delivery per se.
§ 7.e. Set offs, right of retention
Purchaser shall be accorded the right to offset sums against payments due only in instances where such counterclaims have been upheld by a final and non-appealable court ruling, or have been acknowledged by Lürzer GmbH. Moreover, Purchaser shall be authorized to exercise a right of retention solely in such instances where the counterclaim is founded in the same contractual relationship.
§ 7. f. Delivery
All merchandise is shipped at economy rates, the amount payable being charged to the customer under the item shipping costs in the order. If you wish goods to be sent by airmail or courier, please contact Lürzer GmbH directly.
The risk of loss and title for such items passes to you upon our transfer of merchandise to the carrier. This ruling does not apply if you are a consumer (and not a company or other commercial enterprise).
Lürzer GmbH is unable to guarantee that the products requested are always available. In the event of unavailability, your account will be credited.
Any additional charges for customs clearance must be met by you. Lürzer GmbH has no control over these charges and cannot predict what they may be.
§ 8. Submission
Submissions of advertisements, TV commercials and posters to Lürzer´s Int´l Archive constitutes representation that the submitter has the authority to grant, and agrees to grant Lürzer´s Int´l Archive, the right and permission to reproduce, edit and comment editorially on all or any part of the submission in Archive’s editorial section. All such reproductions are free of charge to the submitter. Advertisements that have no symbols near them indicating creative origins are paid advertisements. Archive assumes no responsibility for the return of unsolicited material, and reserves the right to accept or reject any advertising material for whatever reason.
§ 9. Warranty, liability for defects
In the event that the purchased item is found to have a defect that is the fault of Lürzer GmbH, the Purchaser shall be authorized to demand repeat fulfillment (remedying of defects or replacement). Should Lürzer GmbH be unable, or unwilling, to perform repeat fulfillment on account of the unreasonableness of any such demand, or if repeat performance is delayed beyond an acceptable period of time for reasons that are the responsibility of Lürzer GmbH, or if repeat performance otherwise fails to be effected, the Purchaser may choose either to demand an appropriate reduction in the purchase price or to withdraw from the contract of purchase.
Unless any statements to the contrary succeed this provision, all further claims on the part of the Purchaser – irrespective of their legal basis – shall be precluded. Accordingly, Lürzer GmbH shall not be held liable for any damage that may occur yet which does not immediately relate to the delivered item itself; most notably, Lürzer GmbH shall not be held liable for unrealized profits or for other pecuniary losses on the part of the Purchaser. Where liability on the part of Lürzer GmbH is either precluded or limited, this provision shall also cover the personal liability of employees, representatives, or appointed agents.
The preceding limitation of liability shall not apply in the event that the cause of the damage or loss was due to willful acts or gross negligence, or in the case of personal injury.
Where Lürzer GmbH negligently violates an essential contractual duty, the liability to pay compensation for the damages typically arising from such negligence shall be limited.
A period of limitation of twenty-four months, commencing with the date of delivery, shall apply.
§ 10. Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Austria and shall be subject to the exclusive jurisdiction of the appropriate Austrian Courts.
